REQUEST FOR PROPOSAL

REVIEW OF PROVISIONS OF THE PETROLEUM INDUSTRY BILLS AND DEVELOPMENT OF FACT-SHEET

The Civil Society Legislative Advocacy Centre, CISLAC, requests for proposals from a competent consultant to undertake a review of current drafts of all the components of the Petroleum Industry Bill. This is in furtherance of the implementation of a project to promote multi-stakeholder support for the passage of the Bill.

 

Project Background

The need for a better regulatory framework for the oil and gas sector has been long established. The Petroleum Industry Bill (PIB) suffered repeated setbacks due largely to disagreements and poor understanding of the critical issues among stakeholders. These disagreements have centred mostly on the regulatory framework, including power of the Minister, ownership and control of the resources, host community benefits, environmental concerns, appropriate fiscal regime, and a few others. Each PIB process has ended with each administration, to be restarted almost from scratch by the succeeding government.

A different approach of splitting the Bill in parts has achieved some progress in the context of the new Petroleum Industry Governance Bill. The first of the bills, the Petroleum Industry Governance Bill (PIGB) was passed by the Senate. This has rekindled hope amongst stakeholders. However, the need to get the lower house on same page with the upper house is of great importance to ensure a final passage of the PIGB by the NASS and assent by the President. The components of the law addressing the Revenue and Fiscal issues, as well as, Host Communities Concerns have also progressed through the lower house. It is therefore necessary to sustain the momentum by engaging multiple stakeholders to establish a common understanding that will ensure that the PIB becomes law this time around,

 

Expected Deliverable and Scope of Work:

A Review Report of the provisions of the PIGB and other proposed PIB components. The Report will contain the following:

  • An appraisal of the provisions of the various pieces of legislation and their implications for the  overall regulation of the sector
  • The  multiple effects of the non-passage of the Bill on the sector
  • The list of stakeholders in the sector who will be impacted by the proposed provisions
  • The consequences of relevant provisions to specific stakeholders identified.
  • A SWOT analysis of the draft legislations and present approach for their passage
  • Identify the possible risks that can hinder the passage of the Bill and
  • Recommend mitigation strategies to address the identified risks

 

Objective:

To have an information source that can serve as a tool for engaging multiple stakeholders and mobilize their support for the passage of all the components of the PIB by 2018.

 

Expected Outputs

  • A review report  of the provisions of all the current components of the PIB
  • Articulate key messages for advocacy and campaign for the passage if the PIB;
  • Develop a Fact Sheet on the benefits of the PIB useful for advocacy and campaign for the passage of PIB (Legislators, Ministry of Petroleum Resources, Host Communities, Sector-related Trade Unions, Companies, citizens, etc.

 

Time Frame:

The activity should be completed after two weeks from the date of engagement and signing of contract.

This will be negotiable
